These Terms of Service ("Terms") govern your use of Yapsmith ("Service," "we," "us," or "our"). By submitting a service request or interacting with Yapsmith, you agree to these Terms.
1. Service Description
Yapsmith is an AI-powered speed-to-lead platform that helps service businesses respond to customer inquiries within 60 seconds via SMS, phone, or chat. When you submit a service request, Yapsmith automatically routes and responds on behalf of the service business you are contacting.
Yapsmith is a technology intermediary. We are not a licensed contractor, plumber, electrician, HVAC technician, or any other type of service provider. All work is performed by independent service businesses.
2. SMS Messaging Terms
By submitting a service request form on a Yapsmith-powered page, you expressly consent to receive automated text messages (SMS) from the service business you are contacting. These messages may be sent using automated dialing technology.
- Message frequency: Varies based on your inquiry and the service business's follow-up process
- Message and data rates may apply depending on your mobile carrier and plan
- To opt out: Reply STOP to any text message at any time. You will receive a single confirmation and no further messages will be sent
- For help: Reply HELP or contact support@yapsmith.com
Opting out of SMS messages does not cancel any service appointments already scheduled. Please contact the service business directly to modify or cancel appointments.
3. User Responsibilities
By using Yapsmith, you agree to:
- Provide accurate and truthful information in all service requests
- Provide a valid phone number that you own or are authorized to use
- Not submit fraudulent, abusive, or spam requests
- Not use the service for any unlawful purpose
- Not attempt to circumvent or interfere with the automated systems
4. No Guarantee of Service
Yapsmith facilitates connections between customers and service businesses. We do not guarantee that a service business will be available, will respond within a specific timeframe, or will accept your service request. Availability depends on the individual business.
5. Limitation of Liability
To the maximum extent permitted by applicable law, Yapsmith and its affiliates, officers, employees, and agents shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, data, or business opportunities
- The quality, safety, legality, or any other aspect of services provided by independent service businesses
- Any delays, errors, or failures in SMS delivery caused by your mobile carrier
Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed $100 USD.
6. Indemnification
You agree to indemnify and hold harmless Yapsmith and its affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.
7. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after any changes constitutes your acceptance of the new Terms. We will update the "Last updated" date at the top of this page.
8. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law provisions.
